Terms and Conditions for the Instagram Contest (incl. Privacy Policy)
The "Regenbogenschwarz Batik Look" giveaway is organized and conducted by Melanie Negele - Regenbogenschwarz, Riedingerstr. 26 e, 86153 Augsburg, Germany. There is no connection to Instagram, and the platform assumes no liability.
The following terms and conditions apply:
The following will be awarded to all participants:
three vouchers, each worth €50.00 (in words: fifty Euros), redeemable for a purchase in the online shop at regenbogenschwarz.com.
The participation period is from September 5, 2026, 00:00 (CEST) to September 13, 2026, 23:59 (CEST).
To participate, the following steps are required:
🢂 Create a photo showing a personal Regenbogenschwarz batik look, featuring at least one item of clothing from Regenbogenschwarz. AI-generated or AI-created images are not permitted.
🢂 Post the photo on your own, publicly visible Instagram profile and tag the organizer in the caption and on the photo with @regenbogenschwarzfashion.
🢂 Then send the photo by email to nina@regenbogenschwarz.de with the subject line “Batik-Look” and state your Instagram profile name to allow for assignment.
Eligible participants are natural persons aged 18 or over with a residence in Germany, Austria, or Switzerland, who have a publicly visible Instagram profile.
I reserve the right to exclude individuals from the giveaway, especially if they provide false information, commit other manipulations, or use unauthorized tools (including AI).
Submitted content must not contain any illegal, offensive, discriminatory content, or content that violates the rights of third parties (especially copyright, trademark, and personal rights), and must be compatible with Instagram's terms of use and community guidelines.
From all submitted images, the Regenbogenschwarz team will select three favorite images. The evaluation criterion is solely the team's preference; there is no claim to a specific evaluation method or scoring system.
Only entries submitted within the participation period will be considered for prize determination.
Only one entry per person is allowed. Multiple entries from the same person will only be considered once.
I reserve the right to change, cancel, or prematurely terminate the giveaway at any time without prior notice, and participants cannot make any claims.
The winners will be announced on September 16, 2026. They will be notified by email as a reply to the submitted entry email, and their usernames will also be announced in our Instagram Story.
The prize will be sent by email following the winner notification.
No investigations will be made if the prize cannot be delivered. If the winner does not respond to the prize notification within 7 days, the claim to the prize expires.
Exchanges, cash payments, or transfers of the prize are excluded. Legal recourse is excluded. The law of the Federal Republic of Germany applies. Invalid regulations do not affect the remaining conditions.
The giveaway is not associated with Instagram and is in no way sponsored, endorsed, or organized by Instagram. Legal recourse is excluded.
Please note: We will only contact winners via our official Instagram account or via nina@regenbogenschwarz.de. Please report fake accounts immediately.
Data Protection Information:
1. Processing of personal data
By participating, data (name, contact details, email, Instagram username) are collected only to the extent specified, in order to conduct the giveaway and notify in case of a win.
Processing is carried out with consent in accordance with Art. 6 para. 1 lit. a GDPR. Consent can be withdrawn at any time without affecting the processing that has taken place up to that point. The data will be deleted after the end of the giveaway.
Data will not be passed on to third parties.
In the event of a win, consent is given for the publication of the profile or name on Instagram for the announcement of the win. Processing is carried out with consent in accordance with Art. 6 para. 1 lit. a GDPR, which can be withdrawn at any time. All data will then be deleted.
By participating, consent is given for the photo to be used for advertising purposes. Processing is carried out with consent in accordance with Art. 6 para. 1 lit. a GDPR, which can be withdrawn at any time. By consenting to publication on social media, the consenting person is aware that content can be disseminated there and that complete deletion of the photos cannot be guaranteed.
2. Storage duration
Data will only be stored for as long as necessary for the giveaway. After that, they will be deleted after three months at the latest, unless further use has been agreed upon or we have a legitimate interest in storage.
3. Rights of data subjects
In accordance with Art. 15–21 GDPR, participants have the following rights: access, rectification, erasure, restriction of processing, data portability, and objection, in particular to processing under Art. 6 para. 1 lit. f GDPR or for direct marketing.
Right to lodge a complaint with the supervisory authority
In accordance with Art. 77 GDPR, there is a right to lodge a complaint with the supervisory authority if there is suspicion that data is not being processed lawfully.
Right to object
If data is processed on the basis of a legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR, you can object at any time for reasons arising from your particular situation. After the objection, the processing will be stopped, unless compelling legitimate grounds for the processing can be demonstrated that override your interests, or the processing serves the establishment, exercise or defense of legal claims.
